  • California Labor Law: COVID-19 Vaccination Requirements and Medical Records

This topic will feature discussion from labor attorneys at Littler Law Firm, highlighting labor laws surrounding implementation of required COVID-19 vaccination in the workplace, including HIPAA compliance, vaccination terms of employment and exemptions and maintenance of medical records, and tips on successful and legal implementation in the workplace.

Alka Ramchndani-Raj

As an experienced employment lawyer with a concentration in Federal and State Occupational Safety and Health law, Alka Ramchandani-Raj assists employers with a wide range of complex situations with the workforce. Alka has extensive experience handling communicable disease inquiries for clients and she assisted with developing and leading Littler’s COVID-19 task force including developing the strategy behind responding to inquiries and developing products for clients including safety and health and employment policies, return to work plans, and programs for compliance.

Focusing on workplace safety and health, Alka assists employers with pre-injury/illness preventative practices, including site inspections and policy development. Alka also assists employers who have experienced workplace injuries and accidents or are subject to a Federal or state OSHA inspection. She has experience managing catastrophic workplace accidents or fatalities. Alka is an experienced litigator and regularly represents employers in Occupational Safety and Health appeals, settlement conferences, and hearings. She also has broad experience assisting employers with workplace violence issues including obtaining temporary and permanent restraining orders to ensure the workplace is safe for employees. Alka also regularly attends advisory committee meetings as part of Littler’s Workplace Policy Institute and submits comments to proposed regulations. She is a core member of the firm’s Occupational Safety and Health and Workplace Violence practice groups, and a leading member of Littler’s OSHA Woman’s Group.

She also has extensive experience with general employment advice and counsel and litigation matters relating to terminations, retaliation, whistleblowers complaints, discrimination, harassment, ADA accessibility and state agency complaint defense.   Alka is a popular speaker on OSHA and employment related legal issues and she regularly provides training sessions for clients and professional organizations on various topics, including:

Alka is co-chair of the Workplace Safety & Health (OSHA/MSHA) Practice Group. She is also a member of the firm’s Robotic, Artificial Intelligence and Automation practice group, which is focused on providing representation and compliance assistance to employers in the robotic industry and employers integrating automation, AI, telepresence and robotics into their workplace.

Adam Joshua Fiss

Adam J. Fiss represents employers in a variety of labor and employment matters, including defending clients in lawsuits and administrative proceedings that involve wrongful termination, employment discrimination, trade secret and unfair competition, wage and hour, and harassment.

In addition, as co-chair of Littler’s Workplace Violence Prevention Practice Group, Adam has wide-ranging experience, litigating, advising and problem solving with clients on issues relating to concerns of potential workplace violence issues. This includes creating and implementing, policies, trainings, and plans to identify and be prepared for a potential workplace violence situation and counseling clients relating to actual threats of violence or violence impacting the workplace.

Adam also, as a core member of Littler’s Leaves of Absence and Disability Accommodation Practice Group, has extensive experience assisting clients with the design and administration of leave of absence, mandatory paid sick leave laws throughout the United States, and accommodation policies and procedures; counseling employers regarding day-to-day leave and accommodation issues; training management and HR staff in these areas; and defending claims under the Family and Medical Leave Act, Americans with Disabilities Act and related state laws.

Adam also counsels employers on a variety of issues arising under state and federal labor and employment laws and assists employers in the implementation and review of personnel policies and procedures.   He appears in state and federal courts and before the California Labor Commissioner, the California Unemployment Insurance Appeals Board, the Department of Fair Employment and Housing, and the Equal Employment Opportunity Commission. Adam also handles labor relations and has represented both private and public employers in:

  • Collective bargaining negotiations
  • Labor arbitration
  • National Labor Relations Board proceedings
  • Public Employment Relations Board proceedings
  • Administrative mandamus hearings for public entities

Most frequently, Adam works with the following types of clients:

  • Private entities, from small companies to Fortune 500 companies, including those in high tech, medical, retail, manufacturing, and financial industries
  • Public entities including school districts, county offices of education, special districts, and cities

Adam frequently lectures and authors articles on employment and labor law topics. He is the Co-Chair of the Workplace Violence Prevention practice group and is a core member of the firm’s practice groups: Leaves of Absence and Disability Accommodation and Workplace Safety.
